Event Terms and Conditions for The Urban Developer (TUD)
1 Effect of Terms and Conditions
1.1 These terms and conditions together with your registration form (if applicable) (Terms) apply to your registration for and attendance of events held or presented by The Urban Developer and form a binding contract between The Urban Developer.com Pty Ltd ACN 169 148 958 (we/us/our/TUD) and you when you register for or attend a TUD event (Event).
1.2 If you do not agree to these Terms, you must not register for or attend the Event.
1.3 If you register someone other than yourself for the Event, you must ensure that you have the attendee’s authority to register them and are responsible for ensuring that the attendee is aware of and complies with these Terms.
1.4 You acknowledge and agree that TUD may amend these Terms from time to time. Any amendments become effective when posted on TUD’s website www.theurbandeveloper.com (the Website) and TUD encourages you to access and review the Website regularly to keep up to date.
1.5 You will be subject to the Terms in force at the time you register for the Event and any amendments to these Terms will not apply retrospectively.
2 Registration and Payment
2.1 Registration fees (if applicable) are published on the Website in Australian Dollars and are exclusive of GST.
2.2 Registration fees are payable on registration. TUD does not guarantee registration until payment has been received. Payments may be made via credit/debit card or other approved methods as specified during registration.
2.3 Confirmation of registration will be provided upon receipt of payment from TUD or, if the Event is free, receipt of your completed registration form.
2.4 You will not be permitted entrance to an Event unless you have received confirmation of your registration. If you do not receive your confirmation within 2 days, please contact TUD using the contact details set out in these Terms.
2.5 TUD member rates and discounts are available to TUD+ members where advertised. TUD+ membership fees must have been paid in full before the member rate or discount applies.
2.6 Where an early bird discounted registration fee is advertised, registrations must be completed and paid for on or by the advertised early bird closing date. If payment is not received before the closing time and date, the registrant will be charged the standard rate for the Event. Early bird registrations are limited and may sell-out before the advertised closing date. Once the allocated early bird registrations are sold-out, registrations will revert to standard pricing, regardless of date.
2.7 An organisation cannot register for an Event. Registrations must be in the name of an individual person only. Each registration is for 1 attendee only. You must not share a registration or in the case of online content broadcast the content to others.
2.8 Registration closing dates and times are specific to each Event and are set out on the Website.
2.9 In the unlikely event that more than the maximum number of attendees are registered for an event, TUD will give preference to attendees in order of time of registration. All registrants who cannot be accommodated will be advised via email or telephone and, for paid events, offered a full refund.
3 Cancellations and Refunds
3.1 Cancellations must be notified to TUD at least 30 days prior to the Event (not including the day of the Event) or such other final cancellation date specified on the Website (Cancellation Date).
3.2 Subject to TUD’s obligations under clause 8: (a) if the cancellation is notified on or before the Cancellation Date, you will be entitled to receive a full refund of any registration fees paid less administrative fees; and (b) if the cancellation is notified after the Cancellation Date, the attendee is not entitled to a refund (unless otherwise agreed by us in writing).
3.3 No refunds will be given for no-shows.
3.4 Refunds offered in accordance with these terms and conditions will be refunded to the credit card used to make the initial purchase. Refunds for payments made by BPAY, Cheque or EFT will be refunded by EFT.
4 Ticket Sharing and Transfer
4.1 Entry to the Event is personal and non-transferrable. You must not attempt to transfer their entry to any other person, without the express consent of TUD.
4.2 TUD may consent to ticket transfers (in its sole discretion): (a) if requested in writing before the Cancellation Date; or (b) if requested within a reasonable time after the Cancellation Date and before the Event.
5 Event Changes and Force Majeure
5.1 We reserve the right to alter the Event program, faculty, venue, dates, or format due to operational requirements or circumstances beyond our control.
5.2 You will be notified of any material changes via email as soon as practicable. TUD will act reasonably when determining whether a change is material.
5.3 Subject to TUD’s obligations under clause 8, TUD is not liable for cancellation, postponement, or changes to the Event due to circumstances beyond our control, including but not limited to natural disasters, government restrictions, public health emergencies, venue unavailability, or other unforeseen events.
5.4 In case of force majeure events, refunds or Event transfers will be offered at TUD’s discretion.
6 Health and Safety
6.1 You must comply with all health and safety guidelines and public health directions in effect at the time of the Event, including vaccination requirements, mask mandates, or health screenings if applicable.
6.2 If you are feeling unwell or experiencing symptoms you should not attend and should contact us regarding your registration.
6.3 You participate at your own risk, including risks associated with travel, personal safety, and health.
6.4 You acknowledge that and agree that you will adhere to all lawful instructions (including in relation to safety and security) from the TUD, venue staff, or other relevant persons in relation to the Event.
6.5 Failure to comply with any lawful instructions from the TUD, venue staff or other relevant persons in relation to the Event may result in your removal and exclusion from the Event.
7 Attendance and Attendee Conduct
7.1 Professional and respectful behaviour is expected at all times during the event.
7.2 We reserve the right to determine what constitutes inappropriate, disruptive, or unacceptable conduct at the Event.
7.3 We may immediately remove you from the Event, without refund, compensation, or prior warning, if you: (a) do not comply with these Terms; (b) engage in any unlawful or other improper conduct that may jeopardise the safety, wellbeing or enjoyment of any other person or the Event; (c) fail to follow the reasonable direction of the TUD, venue staff or any other authorised person; or (d) engage in conduct we deem, acting reasonably, to be inappropriate, disruptive or offensive;
7.4 We reserve the right to refuse future registrations by you if you have been removed from a previous TUD event.
8 Limitation of Liability & Insurance
8.1 Subject to clause 8.2, 8.3, 8.4 and 8.5and to the extent permitted by law, TUD’s liability is limited to the amount paid for registration.
8.2 Except as contemplated by clause 8.3 nothing in these terms and conditions is intended to exclude, restrict or limit any rights that you may have under the Australian Consumer Law or any other legislation which may not be excluded, restricted or modified by agreement.
8.3 If the Australian Consumer Law or any other legislation provides a statutory guarantee in relation to any goods or services supplied by the TUD in connection with these Terms and the TUD’s liability for failing to comply with that guarantee cannot be excluded but may be limited, then clauses 8.1 and 8.4 do not apply to that liability. Instead, the TUD’s liability for that failure is limited to (at the TUD’s election):
(a) in the case of supply of goods, replacing the goods or supplying equivalent goods, repairing the goods, paying the cost of replacing the goods or of acquiring equivalent goods, or paying the cost of having the goods repaired; or
(b) in the case of a supply of services, supplying the services again or paying the cost of having the services supplied again.
8.4 To the fullest extent permitted by law:
(a) neither party is liable to the other party for any consequential, indirect or special damages under or in respect of these Terms or the Event, regardless of whether that liability arises in contract, tort (including negligence), at common law, in equity, under statute, under an indemnity or otherwise howsoever arising;
(b) we are not liable to you or anyone else for any loss or damage however caused which is suffered in connection with your registration for the Event or attendance at the Event, including but not limited to loss or damage to personal belongings or personal injury, except to the extent the liability arises due to fraud, negligence or wilful misconduct of us, our officers, employees, contractors or agents; and
(c) we exclude all implied representations, warranties, terms and conditions of any kind whatsoever (whether implied by common law, statute or otherwise).
8.5 You are advised to obtain appropriate personal insurance coverage. Attendees are responsible for their own travel arrangements and personal belongings at all times.
9 Photography, Recording and Media
9.1 The Event may be photographed, filmed, and recorded for promotional, educational, archival, and commercial purposes, including but not limited to on-demand video access, podcast episodes, online streaming, and sale or licensing to third parties.
9.2 By attending the Event, you acknowledge and agree that:
(a) you may be photographed, filmed, and recorded at the Event and consent to the unrestricted use, reproduction, and distribution of your image, voice, likeness, and any statements or contributions made during the Event for the purposes specified in clause 9.1, in any media format, without compensation;
(b) you may be contacted by the TUD (or an agent of the TUD) to provide feedback, testimonials or comments about the Event and TUD may use any feedback, testimonials or comments obtained from you, your name, and/or likeness for the TUD’s future promotional and marketing purposes, in any media format, without further reference or compensation.
10 Intellectual Property
10.1 All intellectual property rights in the Event content, including presentations, materials, and recordings, and Website content (including information, logos, trade marks, design, text and images) are owned by the TUD and/or Event exhibitors, partners or speakers.
10.2 Unauthorised reproduction, recording, or distribution of any Event or Website content by attendees or third parties is strictly prohibited without written consent from the TUD.
11 Data Protection and Privacy
11.1 The TUD collects personal information about attendees in connection with the Event for the purpose of organising and facilitating the Event and related activities, providing services to attendees and facilitating the TUD’s internal business operations, including the fulfilment of any legal requirements. This may include sensitive information that you choose to disclose to the TUD, including your dietary or accessibility requirements.
11.2 By registering for the Event, attendees consent to the TUD:
(a) collecting and using their personal information for Event-related purposes, including registration processing, communication, and Event management, including to contact the attendee in connection with the Event; and.
(b) disclosing their personal information to the TUD’s affiliated organisations, service providers and other third parties engaged to provide services in connection with the Event.
11.3 If the personal information provided to the TUD is incomplete or inaccurate, the TUD may not be able to communicate with the attendee or facilitate the attendee’s attendance at the Event.
11.4 More detailed information about the way the TUD collects, holds, uses and disclosnes personal information in connection with the Event, how you can access and correct your personal information, and how you can make a complaint about how the TUD has handled your personal information can be found in the TUD’s Privacy Policy. 12 Accessibility
12.1 We strive to ensure our events are accessible to all attendees. Please contact us during registration to discuss any accessibility requirements or reasonable adjustments needed.
13 Governing Law and Disputes
13.1 These Terms are governed by the law in force in the State of Queensland and each party submits to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to determine appeals from those courts, in relation to any proceedings that may be brought at any time relating to these Terms.
14 General
14.1 These terms and conditions constitute the entire agreement between the attendee and the TUD regarding Event attendance.
14.2 If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
